Madoff gets bail revoked and heads straight to jail

Bernie Madoff is heading straight to jail—where he arguably should have been all along. While that won’t make it any easier for the almost 5,000 people who may have lost close to $65 billion (only $1 billion has been recovered so far), it will likely give the public some comfort. The thought of Madoff returning to his $7 million apartment — or rather, his wife’s apartment as she is now claiming close to $70 million in assets as her own — had stoked outrage.
Madoff admitted in court today that he “never invested the funds in securities as promised” before adding that he was “deeply sorry” for his actions. Having promised high returns (in some cases, as high as 46%), he said he felt compelled to deliver. Madoff even claimed to be “grateful” for the chance to comment on his crimes.
There were a few moments of lightness in the courtroom—especially when Madoff’s lawyer noted how his client “at his wife’s own expense,” had paid for security, presumably to make sure he didn’t escape. That prompted a burst of laughter from the spectators.
Instead of remaining under house arrest, Madoff will now have to wait in jail to hear what his final sentence will be. Meanwhile, prosecutors are looking closely at the actions of family members, others at his company and the accounting firms that issued clean bills of health over the years.
Other questions remain:
What about the conspiracy charge?
Madoff refused to admit to conspiracy, as that would have meant implicating other people. Right now, his top motivation seems to be (a) to protect as many assets as possible for his family and (b) to make sure no one else takes the fall.
Who else is under suspicion?
Prosecutors are looking closely at Ruth Madoff, Bernie’s wife, who withdrew millions shortly before his crimes became public. First, what did she know of the scheme during their 45 years of marriage? And did she help him hide assets? Madoff’s brother and two sons, who worked at the firm, are under investigation — as are the many others who were involved in the firm.
How will the victims recover the money?
While only a fraction of the funds have been recovered and much of the money will likely never be recovered, investors may at least be able to claim some of the taxes they paid on income that — it turned out — they weren’t actually earning in Madoff accounts.
With the Madoff name now associated with the largest Ponzi scheme in history, one wonders if some family members might feel tempted at times to change their name. While the once revered money manager’s fate now appears sealed, the Madoff saga is far from over.
