China's congress grants the jurisdiction upon the specific agency which administer the laws, in this case, department of commerce.
if you want to know who gives the power to china's congress, don't ask me... I am not a chinese law expert. what I said is just based on basic knowledge of a legal system: how the power is delegated because you can not just rely on the congress to do everything for everyone, right? i said "government" in general, not just administrative branch, because it is possible that sometimes congress may grant a jurisdiction to other branches.
but yes, the jurisdiction so granted should be within the limit of the constitution, and if you don't like how the department of commerce handles the deal, well, in theory, first, you can challenge the department of commerce on the ground that their decision is in violation of the anti-trust law, and two, you have the option to challenge the anti-trust law on constitutional grounds.
