The company is a global group of energy and petrochemicals, operating in over 140 countries and territories and employing approximately 109,000 people. The company explores for, produces and refines oil and markets a full range of oil products. It also finds, produces and transports gas and is active in renewable energy- solar, biofuels and wind sources. Currently, the company is expanding rapidly in mainland China with 21 wholly-owned or joint venture companies employing about 1,600 staff. At the end of 2005, the investment on the mainland China was about US$ 3.5 billion, one of the largest commitments of any international energy company.
l Independently develop and cause to be implemented, value enhancing direct and indirect taxation strategies to optimize the taxation position of the group within the parameters of the law and the company’s business principles and the business requirements of the operating units and corporate activities, and manage the defense of these positions before the relevant tax authorities;
l Provides tax advice and support for all major business transactions and projects, and liaising with Business Tax Managers to maximize tax savings across all relevant tax jurisdictions, including the identification, negotiation and implementation of maximum tax/tariff incentives for all projects and transactions;
l Advises HR on all personal income tax matters for staff including expatriates;
l Maintain and enhance financial controls over direct taxation matters, and ensure effective tax controls are maintained over indirect taxation matters;
l Manage the provision of compliance, assurance and advice services to Companies in China by the Tax Department to ensure compliance with the law and “best practice” group procedures and practices;
l Ensure timely and accurate lodgment of income tax returns and other related information required by taxation authorities;
l Advise Country Chair on protection of the company’s reputation with respect to tax matters in China;
l Manage the skillpool of tax professionals in China and provide technical review, advice and mentoring to tax staff. Manage succession planning with particular regard to development of Chinese nationals;
l Represent the company before governmental authorities and within industry and professional organizations concerning tax matters. Specifically, manage the relationship with the SAT, local tax bureau, the Ministry of Finance and other government bodies, National Oil Companies & JV partners involved in taxation matters, including the management of tax audits and appeals;
l Manage & Report on timely basis to group and region on material China tax exposures and tax savings;
l To ensure a competitive tax charge through tax planning by taking advantage of all available tax exemptions and incentives & ensuring that all returns and payments are filed on time, complete and in full compliance with the law;
l To keep abreast of changes in tax laws and practice; anticipate and lobby for tax law changes; initiate appropriate actions and procedures to provide timely advice & minimize impacts to businesses;
l An additional challenge is to lead, motivate, coach and develop members of the China tax team and to actively manage local succession planning and integrate the China tax team into the wider East Functional Tax team.
REQUIREMENTS:
l Approximately 10 years tax experience obtained working as a full time tax professional for multinational, or in a professional tax practice;
l Thorough knowledge and experience in China tax law and practices;
l Recognized professional qualification (double degree accounting/ law preferable, however, single degree in accounting or law with experience acceptable;
l Significant tax and financial knowledge and experience in the area of direct taxation, together with an understanding of the interaction with indirect taxes;
l High level of knowledge regarding the interaction of indirect taxes, particularly VAT and customs and how these impact the businesses in China;
l Strong negotiation skills and a proven ability to negotiate tax issues with fiscal authorities;
l High degree of integrity in dealing with Revenue authorities and in handling sensitive and confidential information;
l Thorough knowledge of business controls in a tax environment;
l Thorough knowledge of tax accounting in Group Accounts;
l Exposure to refinery operations to thoroughly appreciate concepts and procedures behind excise tax & customs duty obligations;
l Ability to clearly articulate complex tax issues in simple manner to ensure understanding by non tax professionals, both verbally and written;
l Ability to organize and manage many complex tasks simultaneously;
l Strong leadership & coaching skills;
l Sound judgment and good interpersonal skills;
l An Appreciation of SAP & use of IT tools for managing the tax function.
